DATA PROTECTION STATEMENT

Collection, Processing and Use of Personal Data

The purpose of our company is to organise and/or arrange tourism services, to operate a ticket office, as well as to provide catering services and the related administrative, billing and service activities. The collection, processing and use of data for these purposes is based on Art. 6(1)(b) and (f) GDPR (performance of a contract and legitimate interest).

Users may visit the WKE website without providing any personal details. WKE only stores access data without any personal reference, such as the name of the internet service provider, the page from which the WKE website is accessed, or the name of the file requested. In addition, anonymised or aggregated demographic data (e.g. age groups, interests or regional allocation) may be collected and evaluated, which does not allow any conclusions to be drawn about individual persons – see also the section “Use of Google Analytics”. This data is evaluated exclusively to improve WKE's offering and does not allow any conclusions to be drawn about the person concerned.

Personal data is only collected if the customer voluntarily provides it to WKE as part of a registration (opening a customer account), an order, or registration for the newsletter. WKE uses this data, without the customer's separate consent, exclusively to fulfil and process the order. Once the contract has been fully performed and the purchase price has been paid in full, the customer's data is blocked from further use and deleted after expiry of the statutory tax and commercial retention periods (legal basis: Art. 6(1)(c) GDPR), unless the customer has expressly consented to further use of their data. Data provided as part of the registration remains stored until the customer account is deleted. The customer account can be deleted at any time by sending an email to datenschutz@creartive-group.com. Subject to compliance with statutory retention periods, the personal data will be deleted immediately thereafter. Upon signing up for the newsletter, the email address is used, with the customer's consent, for WKE's advertising purposes (Art. 6(1)(a) GDPR) until the customer unsubscribes from the newsletter. Unsubscribing is possible at any time.

Use of Cookies

WKE uses cookies on various pages to make visiting the website more attractive and to enable the use of certain functions. Cookies that are not technically necessary (in particular for analytics and marketing purposes) are only set with the user's consent pursuant to Art. 6(1)(a) GDPR. These are small text files that are stored on the user's computer. Most of the cookies used are deleted from the user's hard drive at the end of the browser session (so-called session cookies). Other cookies remain on the user's computer and enable WKE to recognise the user's computer on their next visit (so-called persistent cookies).

Use of Facebook Plugins

Plugins of the social network Facebook, 1601 South California Avenue, Palo Alto, CA 94304, USA, are integrated into the WKE website. The provider is Meta Platforms Ireland Ltd. The Facebook plugins can be recognised by the Facebook logo or the "Like" button on the page. The following link provides an overview of the Facebook plugins: developers.facebook.com/docs/plugins/. When the user visits these WKE pages, the plugin establishes a direct connection between the user's browser and the Facebook server. As a result, Facebook receives the information that the user has visited the WKE page with their IP address. If the user clicks the Facebook "Like" button while logged into their Facebook account, the user can link the content of the WKE pages to their Facebook profile. This allows Facebook to associate the visit to the WKE pages with the user's account. WKE points out that, as the provider of the pages, it has no knowledge of the content of the data transmitted or of its use by Facebook. If the user does not want Facebook to be able to associate the visit to the WKE pages with the user's Facebook account, the user must log out of their Facebook account.

Use of Google Analytics

This website uses Google Analytics, a web analytics service provided by Google Inc. (provider: Google Ireland Ltd.). Google Analytics uses so-called "cookies", text files that are stored on the computer and that enable an analysis of the use of the website. This is only used with the user's consent (Art. 6(1)(a) GDPR). The information generated by the cookie about the use of this website is generally transferred to a Google server in the USA and stored there. However, if IP anonymisation is activated on this website, Google will first shorten the user's IP address within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate the use of the website by visitors, to compile reports on website activity, and to provide the website operator with further services relating to website and internet usage. In this process, anonymised or aggregated demographic data (e.g. age groups, interests or regional allocation) may be collected and evaluated, which does not allow any conclusions to be drawn about individual persons. The IP address transmitted by the browser as part of Google Analytics is not merged with other Google data. Users can prevent the storage of cookies by adjusting their browser software accordingly; however, WKE points out that in this case it may not be possible to use all functions of this website to their full extent. In addition, users can prevent the collection of the data generated by the cookie and related to their use of the website (including their IP address) by Google, as well as the processing of this data by Google, by downloading and installing the browser plugin available at the following link: tools.google.com/dlpage/gaoptout?hl=de.

Use of OpenAI for Marketing Purposes

For the creation and optimisation of marketing content, WKE uses services provided by OpenAI (OpenAI Ireland Ltd. or OpenAI, L.L.C., USA). In connection with this use, personal data may be transmitted to OpenAI. This transfer is based on the user's consent (Art. 6(1)(a) GDPR) or on WKE's legitimate interest in efficient and targeted customer communication (Art. 6(1)(f) GDPR). As OpenAI may also process data outside the European Union or the European Economic Area (in particular in the USA), the transfer is carried out subject to appropriate safeguards (e.g. EU Standard Contractual Clauses) to ensure an adequate level of data protection. Users may object to the use of their data for this purpose at any time with effect for the future.

Disclosure of Personal Data

Customer data is disclosed to the shipping company commissioned with delivery, insofar as this is necessary for the delivery of tickets. To process payments, WKE forwards the customer's payment data to the credit institution commissioned with the payment. Further recipients may include IT service providers, hosting providers or ticketing systems, insofar as this is necessary for the performance of the contract. Otherwise, personal data is not disclosed.

Right of Access

Under data protection law, users have the right to free-of-charge information about the data stored about them, as well as, where applicable, the right to rectification, restriction or erasure of this data. In addition, users have the right to restriction of processing, data portability, and the right to lodge a complaint with the competent data protection authority.

Data Security

Personal data is transmitted in encrypted form during the ordering process using the "SSL" transmission method. WKE secures this website and other systems through technical and organisational measures against loss, destruction, access, alteration or disclosure of data by unauthorised persons.

Availability of Consent Declarations

Users may have expressly given WKE the consent set out below, and WKE has recorded this consent. Under the E-Commerce Act, WKE is required to keep the content of consents available for retrieval at any time. Users may withdraw consent given at any time with effect for the future (Art. 7(3) GDPR).
